What this form is for
Certificate of Foreign Status of Beneficial Owner (W-8BEN). A W-8BEN certifies to a US payer that you are not a US person, and claims any reduced withholding rate a tax treaty between your country and the United States allows.
Who needs it
Non-resident individuals receiving US-sourced income — royalties, dividends, interest, or payment for services.
When you do not need it
US citizens and residents use a W-9. Foreign entities rather than individuals use W-8BEN-E, which is a different and much longer form.

Have these to hand — stopping halfway to look one of them up is how a ten-minute job becomes an evening.
- Your country of residence for tax purposes
- Your foreign tax identifying number
- The treaty article you are claiming under, if any
How to fill it in

What goes wrong
- A W-8BEN is valid until the end of the third year after signing, then it must be renewed. Payers usually withhold at 30% the moment it lapses.
- Leaving Part II blank means no treaty benefit is claimed, even if you are entitled to one.
Where it goes
Follow the address or e-file route printed in the current IRS instructions for this form. Those change between tax years, so check the instructions rather than reusing last year’s envelope.
